A Record of Success Defending Against Employee Theft Charges

I have handled dozens of employee theft cases for clients accused of stealing amounts that are relatively low up to six figures from their employers. Judges take employee theft charges very seriously, in that it involves a breach of trust.

In the dozens of employee theft cases I have defended, I have successfully fought for a resolution to the case that kept most of my clients out of jail and in some cases free of a criminal record. The facts of each case are different, and a skilled attorney knows how to work with the facts of each case.

Restitution Is a Critical Part of Defending Against Theft Charges

In many cases, the willingness of the accused to pay back the money stolen, or return the stolen vehicle, is the key to keeping the client out of jail. This promise to pay back money stolen is called restitution in criminal law. A restitution schedule, plus an argument based on mitigating factors that show how my client's actions were based on particular stresses and not a pattern of criminal behavior, often lead to a probation-only result.

In some cases, I am able to achieve a result for my clients that prevents them from having a criminal record altogether. In some theft cases, I have successfully negotiated with the state's attorney for a suspended sentence. In a suspended sentence, my client successfully serves a period of probation, after which the conviction is stricken and the client's record is left clean.

My client was charged with auto theft, and I tried his case in front of a jury. No witness could firmly identify him as the person who stole the car. The ignition of the car was not damaged, and my client had a key to the car provided to him by an acquaintance. The jury returned a verdict of not guilty.
