Defending Against Weapons Charges
Preparing a defense requires an analysis of the facts. What were the circumstances that led to the police finding the weapon? Was it a car stop, house raid, accosting on the street? What was the alleged probable cause? Was there consent?
- Where did the police find the gun or other deadly weapon?
- Did the police have probable cause to search where the gun was found?
- If the weapon was found during a traffic stop, had the police already held you for too long before searching for the weapon?
If the gun crimes charge involves my client's status as a convicted felon or as a "career criminal in possession," then I make sure that the circumstances fit the legal definition of those two crimes. These are serious crimes that carry serious potential penalties — but if the police or the prosecuting attorneys have their facts wrong, it may be possible to obtain a dismissal, a not guilty verdict or a successful plea bargain for a lesser crime and lower sentence. A successful motion to suppress can also lead to a not guilty verdict.
