Domestic violence charges carry a lot of emotional weight, but they do not carry higher penalties than other types of assaults. In addition to the usual factors that I evaluate, such as the facts of the case, what do any witnesses say, where did the assault allegedly take place, what if any injuries were there? I look at what is going on with the person's spouse/partner/girl friend/boy friend, etc. What is the motive here? Is the victim credible, etc.?
Every domestic violence charge is different. I take a careful look at every piece of evidence in each domestic violence defense case — and I work with my client to build as strong a defense as possible.
