Successfully Defending Against an Assault Charge
Defending against an assault charge requires the attorney to evaluate many factors. Each case has facts that are unique to that specific case. Who was the victim, who are the witnesses, do they know the person charged? There may be serious issues to raise with regard to eyewitness identification.
In many assault cases, there may be new witnesses besides the victim. There may be serious credibility issues to pursue in an effort to discredit the victim.
If one is convicted, there is a wide range of what can happen. Many times, even after a conviction, a lawyer can prevent a conviction from appearing on your record.

Investigating Motive and the Scene
In cases where the victim and the accused know each other, I frequently take a hard look at motive. Does the victim have a reason to make a false assault complaint? Is it really about child custody or a divorce? Is there a jealousy motive? Was the event more like a two-sided fight than a one-sided assault? Was it self-defense?
I also carefully review the crime scene by reviewing photographs and video, if available. In serious felony cases, I work with expert crime scene investigators and event reconstruction experts, if appropriate. The crime scene can say a lot about what actually happened.
